1. Acceptance of Terms
Welcome to Tubentum. These Terms & Conditions ("Terms") are a binding legal agreement between you and Snapsell Inc. ("we," "us," "our," or "the Company") regarding your use of the Tubentum software and services ("Service"). By accessing or using our Service, you agree to be bound by these Terms.
2. Order Process and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you purchase our Service, you are entering into an agreement with Paddle, subject to Paddle's Checkout Buyer Terms and Conditions.
3. The Tubentum Service
Tubentum is a Software-as-a-Service (SaaS) tool that provides AI-assisted video editing features for content creators. Our Service is designed to streamline the content creation process through features such as automatic transcription, content analysis, and other AI-powered editing tools. The quality and accuracy of AI-generated content may vary. We reserve the right to add, modify, or remove features from the Service at any time.
4. Subscriptions and Payments
The Service may be available on a subscription basis. All subscription terms, including billing cycles, pricing, and features, will be clearly presented to you before you commit to a purchase. You are responsible for all charges associated with your subscription.
5. User Accounts
To access the Service, you must register for an account. You must be at least 18 years of age. You agree to provide true, accurate, and complete information and are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
6. User Content and Intellectual Property
6.1. Your Content
You retain all ownership rights to the content you upload, create, or process using Tubentum ("User Content"). You grant us a limited, non-exclusive, worldwide license to access, use, process, and display your User Content solely for the purpose of providing and improving the Service. You are responsible for ensuring you have all necessary rights and permissions for the User Content you use with our Service.
6.2. Our Intellectual Property
The Service, including its "look and feel," design, features, software, and all content created by us, is owned by Snapsell Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission. "Tubentum" and our associated logos are trademarks of Snapsell Inc.
6.3. Prohibited Content
You agree not to upload or process any User Content that infringes any copyright or intellectual property rights; contains illegal, harmful, hateful, or offensive material; violates any person's privacy rights; or contains malware or other harmful code.
7. Acceptable Use Policy
You agree not to misuse the Service. This includes, but is not limited to, agreeing not to:
Use the Service for any illegal or fraudulent purpose.
Attempt to gain unauthorized access to our systems or another user's account.
Interfere with, disrupt, or place an unreasonable load on the Service or its servers.
Use automated systems ("bots," "spiders," "scrapers") to extract data from the Service.
Resell, lease, or redistribute the Service without our express written permission.
Violate any applicable local, state, national, or international laws or regulations.
8. Service Availability and Modifications
We strive to maintain high Service availability but do not guarantee that the Service will be uninterrupted or error-free at all times. We may modify, suspend, or discontinue any feature or part of the Service with reasonable notice where possible. We reserve the right to impose usage limits to ensure service quality and fairness for all users.
9. Privacy and Data Protection
Your privacy is important to us. Your use of our Service is also governed by our Privacy Policy. We collect, process, and protect your data as described in our Privacy Policy.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SNAPSELL INC. SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SNAPSELL INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, OR USE, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Snapsell Inc. from any claims, damages, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your User Content.
13. Termination
We may terminate or suspend your account immediately for breach of these Terms, non-payment of fees, or fraudulent activity. Upon termination, your right to use the Service will cease immediately.
14. Dispute Resolution
14.1. Informal Resolution
Before filing a legal claim, you agree to try to resolve disputes informally by contacting us at support@snapsell.app.
14.2. Governing Law
These Terms are governed by the laws of the Republic of Korea.
14.3. Jurisdiction
Any disputes shall be resolved in the courts of Seoul, South Korea.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice in the Service. Continued use after changes constitutes acceptance.
16. Miscellaneous
If any provision is found unenforceable, the remaining provisions continue in effect. Our failure to enforce any right is not a waiver of that right. These Terms constitute the entire agreement between us.

Refund Policy

1. 14-Day Money-Back Guarantee
We offer a 14-day money-back guarantee for all new subscriptions to Tubentum. If you are not satisfied with our Service for any reason, you can request a full refund within 14 days of your initial purchase.
2. How Refunds Work
All payments and refunds are securely processed by our Merchant of Record, Paddle.com. When a refund is issued, it will be credited back to your original payment method, typically within 5-10 business days.
3. Eligibility for Refunds
3.1. Within the 14-Day Money-Back Guarantee Period
For any first-time subscription purchase, you are eligible for a refund if you request it within 14 days of the original purchase date. However, to prevent abuse of our consumption-based AI features, if you have consumed AI credits included with your subscription, the calculated value of the consumed credits will be deducted from your total refund amount.
3.2. After the 14-Day Guarantee Period
Generally, refunds are not provided after the initial 14-day guarantee period has expired. However, we may consider providing a refund in exceptional circumstances like billing errors or major technical issues.
3.3. Generally Not Eligible for a Refund
Subscription renewal charges.
Consumed AI credits.
Accounts suspended for violations of our Terms of Service.
4. How to Request a Refund
To request a refund, please email our support team at support@snapsell.app with your account email and order number from your Paddle receipt.
5. Subscription Cancellations
5.1. Cancellation Process
You can manage and cancel your subscription at any time directly from your Account Settings on our website. The "Manage Subscription" button will direct you to a secure portal hosted by our payment partner, Paddle.com.
5.2. What Happens After Cancellation
Your access to the Service will continue until the end of your current paid billing period. After your subscription period ends, your account will become inactive, and you will lose access to the Service and all of your User Content.
6. Chargebacks and Disputes
Before initiating a chargeback, we kindly ask that you contact our support team first at support@snapsell.app to resolve any issues directly.
7. European Union (EU) Residents
Residents of the EU have a statutory right to a 14-day "cooling-off" period. By using the Service immediately after purchase, you acknowledge that you waive this right of withdrawal. Our 14-day money-back guarantee provides a similar benefit to all our customers.
